  We offer a simple, straightforward and affordable way to for individuals and small businesses to apply to register their trademarks.  Our goal is to simplify the application filing process and ensure that your application is completed correctly so that there is little chance of rejection from the USPTO.

We never recommend that you file a trademark application without first obtaining a thorough search to ensure that the trademark you have chosen isn't in use by another individual or company. The type of search you need depends on several factors including your budget, the type of trademark you have chosen and the length of time (if any) you have used the trademark.  We have three search options:

  Comprehensive Federal, State and Common-Law Search
    $375 (word mark only)
  US Patent and Trademark Office Filing Fee
    $325 per class of goods or services
  US Patent and Trademark Office 'Statement of Use' Filing Fee
    $100 per class of goods or services - If you file an application before you actually begin using your trademark (this is called an Intent-to-Use application) the USPTO charges this additional fee when you file a Statement of Use indicating that you have started using the trademark.

Trademark Application Filing & Monitoring:

We can file and monitor the progress of your application and forward the registration certificate to you as soon as it is received.  All you do is complete our online form with the information we need to prepare your application.  Once we receive all of the necessary information, we immediately prepare your trademark application and all other materials that must accompany the application.  Within five business days (or two business days for expedited applications) you will receive the application by email for your electronic signature.

For $500 you get:
- a complete trademark application prepared by a licensed attorney specializing in trademark law
- we file the application for you and receive all correspondence from the US Patent and Trademark Office on your behalf
- we place your application on our docketing system and monitor all follow up dates and US Patent and Trademark Office deadlines, inform you immediately of any correspondence from the US Patent and Trademark Office and respond to any informal issues on your behalf

What is NOT included in the Application Filing & Monitoring Package:
- the USPTO filing fee of $325 per class of goods or services
- our services in responding to any formal* objections from the USPTO
- the USPTO Statement of Use filing fee of $100 per class of goods or services (applicable ONLY IF your application is filed before you actually begin using your trademark in which case you must provide evidence of use of the trademark AFTER the initial filing of your application)

* A formal objection from the USPTO is anything other than a simple matter that can be handled by telephone call to the PTO Examiner

Knockout Search

– $50 (word mark) – This is the minimum search recommended before filing an application. This search includes only federal and state trademark applications and registrations that are identical to your trademark. The fee includes the search itself as well as review of the search by a licensed trademark attorney who will point out any trademarks that could potentially block your use or registration of your chosen trademark. We offer this search free of charge with any new trademark application.

Screening Search (Federal and State)

– $200 (word mark) - $250 (design mark) – This more extensive search includes federal and state trademark applications and registrations that are identical or similar to your trademark.  Again, a licensed trademark attorney will review the search results and give you a brief written report pointing out any potentially conflicting trademarks. Because the USPTO could reject your application if there is a trademark that is not identical, but similar to your trademark, it is important to consider any similar trademarks that might exist that could block your use and registration of your mark.  The fee includes the search, review by a trademark attorney and a written report pointing out any potentially conflicting trademarks.

Comprehensive Federal, State and Common Law Search

– $375 (word mark only) The most comprehensive search we offer includes everything covered in the Screening Search as well as a common law search. An individual or company can have rights in a trademark even without filing a federal or state trademark application, simply by using the trademark.  For this reason, it is important to review all uses of a particular word or phrase to make sure it isn't being used by someone else.  The fee includes the search, careful review of the search results by a trademark attorney and a written report pointing out any potentially conflicting trademarks.

US Patent and Trademark Office Filing Fee

– $325 – The US Patent and Trademark Office charges a fee of $325 for each class of goods or services. In some cases, related products or services covered under your application may fall within a single class of goods or services. For example, you may sell carpeting and rugs, linoleum and wall hangings all under the same brand name (trademark). In this case, since all of these products fall in Class 27, the filing fee for your application would be $325. However, sometimes related goods or services fall in separate classes. For example, if you sell clothing, leather jewelry and umbrellas all under the same brand name, you would need to file your application covering three classes of goods. Since clothing falls in Class 25, leather jewelry falls in Class 20 and umbrellas fall in Class 18, the filing fee for your application would be $975.

US Patent and Trademark Office Statement of Use Filing Fee

– $100 – If you file a trademark application before you actually begin using your trademark (yes, it is possible to “reserve” a trademark this way, it’s called an Intent to Use application) the application will proceed through the process as any other application. However, once the examination phase is completed, you will have to file a Statement of Use showing that you have begun using the mark. The US Patent and Trademark Office charges a fee of $100 for each class of goods or services covered by your application.

Preparation of Formal Responses to USPTO Rejections

- If your application encounters any objections from the USPTO, we can also assist you in responding to and arguing against those objections.  These services are not included with our trademark filing packages and are arranged and billed separately, on an hourly basis.  Contact us for more information and an estimate of the cost to prepare and file a response.

Preparation and Filing of Other Required Documents

- We can also assist you with the preparation of routine maintenance documents that must be filed with the USPTO in connection with pending trademark applications and existing trademark registrations.  These include:  Statements of Use, Requests for Extensions of Time to File Statements of Use, Assignments of Ownership, Affidavits of Continuing Use, etc.  Contact us for more information as to the various costs for filing these documents.

Preparation and Filing of Renewal Applications

- We can also assist you with the preparation of routine maintenance documents that must be filed with in connection with registered trademarks as well as renewal applications for trademarks that are coming up on the renewal deadline.  Contact us for more information and a cost estimate. 

Domain Name Disputes and Trademark Enforcement
